Article 1: Definitions

In these general terms and conditions, the following definitions apply:

  • Contractor: 24nannies, located at Ridder van Cuykstraat, Boxtel, registered with the Chamber of Commerce under number 61277401.
  • Client: The natural or legal person making use of the services of 24nannies.
  • Nanny: The person selected and assigned by 24nannies who provides the agreed-upon services.
  • Services: All services offered by 24nannies, including but not limited to in-home babysitting, event nanny, live-in nanny, and other forms of childcare and guidance.
  • Agreement: The contract between the client and the contractor regarding the provision of services.
  • Written Communication: In these terms, “written” also includes electronic communication such as email, provided the authenticity of the sender can be sufficiently established.

Article 2: Applicability

2.1 These general terms and conditions apply to all quotations, agreements, and services of 24nannies unless otherwise agreed in writing.

2.2 Deviations from these terms are only valid if they have been agreed upon in writing between the contractor and the client.

2.3 These general terms and conditions also apply to all future legal relationships between the contractor and the client unless otherwise agreed.

Article 3: Quotations and Formation of Agreement

3.1 All quotations from 24nannies are without obligation and valid for 30 days unless otherwise stated.

3.2 The agreement is established through written acceptance of the quotation by the client or by the actual commencement of service provision by 24nannies.

3.3 24nannies reserves the right to refuse assignments without stating reasons.

Article 4: Services

4.1 24nannies offers various forms of childcare and guidance, including but not limited to:

  • In-home babysitting
  • Event nanny
  • Live-in nanny
  • Travel/holiday nanny
  • Special needs nanny
  • Other nanny services

4.2 The specific details of the services will be recorded in the agreement between the contractor and the client.

4.3 24nannies commits to executing the services to the best of its knowledge and ability, in accordance with the agreements made in writing with the client.

Article 5: Rates and Payments

5.1 The rates for 24nannies’ services are stated in the quotation and/or agreement and include VAT unless otherwise indicated.

5.2 Payment must be made within 14 days from the invoice date unless otherwise agreed in writing.

5.3 If payment is not made on time, the client is legally in default and owes interest of 1% per month on the outstanding amount. Additionally, all judicial and extrajudicial collection costs will be borne by the client.

5.4 24nannies reserves the right to index rates annually. The client will be notified in writing of any rate changes at least 30 days in advance.

Article 6: Booking and Cancellation Policy

6.1 Cancellation by the client must be made in writing.

6.2 If cancellation occurs within 14 days before the start of the service, the client is liable to pay 50% of the agreed amount.

6.3 If cancellation occurs within 7 days before the start of the service, the client is liable to pay 100% of the agreed amount.

6.4 If 24nannies is unable to provide services due to force majeure, it will strive to offer an alternative solution. In such cases, 24nannies is not liable for any damages.

Article 7: Liability and Insurance

7.1 24nannies acts as an intermediary between the client and the employee. 24nannies does not have an employment relationship with the employee and cannot be held liable for actions or omissions of the employee, nor for any resulting damages.

7.2 The liability of 24nannies is limited to the amount paid out by the liability insurance of 24nannies in the relevant case.

7.3 The client is required to have business liability insurance (AVB) that covers any damages caused by the candidate.

7.4 24nannies is not liable for indirect damages, including consequential damages, lost profits, missed savings, or damages due to business interruption.

7.5 24nannies is not responsible for agreements or contract terms between the client and the candidate/employee.

7.6 It is the responsibility of the client and the employee to take out liability and accident insurance. This also applies to all other types of insurance.

Article 8: Privacy and Confidentiality

8.1 24nannies processes personal data in accordance with the General Data Protection Regulation (GDPR).

8.2 Both parties are required to maintain confidentiality regarding all confidential information obtained in the context of the agreement.

8.3 24nannies takes appropriate technical and organizational measures to protect the personal data of the client and the children against loss or unlawful processing.

Article 9: Complaints Procedure

9.1 Complaints regarding the execution of the agreement must be submitted in writing and with justification to 24nannies within 14 days of discovery.

9.2 24nannies will respond in writing within 14 days of receiving the complaint. If a complaint requires a longer processing time, 24nannies will send an acknowledgment of receipt within 14 days, including an indication of when the client can expect a more detailed response.

9.3 If the complaint cannot be resolved through mutual consultation, a dispute arises that is subject to the dispute resolution procedure as described in Article 11.

Article 10: Amendments to the Terms and Conditions

10.1 24nannies reserves the right to amend these general terms and conditions.

10.2 Changes will be communicated to the client in writing at least 30 days before the effective date.

10.3 If the client does not agree with the amended terms, they have the right to terminate the agreement in writing within 14 days of receiving the revised terms.

Article 11: Governing Law and Jurisdiction

11.1 These general terms and conditions and the assignment to which these recruitment conditions apply are governed by Dutch law.

11.2 Disputes arising from or related to the assignment to which these general terms and conditions apply, as well as disputes regarding these general terms and conditions, will be brought before the competent court in ‘s-Hertogenbosch if they fall within its jurisdiction.

Article 12: Miscellaneous Provisions

12.1 If one or more provisions of these general terms and conditions are wholly or partially void or declared invalid at any time, the remaining provisions will remain fully applicable. 24nannies and the client will consult to agree on new provisions to replace the invalid or voided provisions, maintaining the original intent and purpose as much as possible.

12.2 24nannies is entitled to engage third parties for the execution of its services, exercising due care. The liability provisions as described in Article 7 also apply to third parties engaged by 24nannies.
